OVERVIEW
Welcome to ernesto. “We”, “us” and “our” refer to UAB Coop Lithuania, which operates the ernesto store and this website. The website, content, tools, products and services made available through it are referred to as the “Services”. ernesto uses Shopify to provide the Services.
These Terms and Conditions, together with the policies referred to in them, govern access to and use of the Services. By using the site or placing an order, you agree to these Terms and our Privacy Policy.
1. Access and account
By using the Services you confirm that you meet the age requirements of applicable law. Information supplied for purchases, payment and delivery must be accurate, current and complete. You are responsible for keeping your account credentials secure and for activity carried out through your account.
2. Products
We aim to display products and services accurately, but colours, images and appearance may vary by device. Descriptions, availability and assortment may change without notice, and we may limit quantities or availability where appropriate.
3. Orders
Submitting an order is an offer to purchase. ernesto may accept or reject an order to the extent permitted by law. An order is accepted when we confirm acceptance. If an order is changed, rejected or cancelled, we will try to contact you using the details supplied. Returns and exchanges are governed by our Refund Policy.
4. Prices and billing
Prices, discounts and promotions may change. The applicable price is the price shown when the order is placed and in the order confirmation. You agree to provide valid, complete and accurate purchase and payment information and to pay the amounts due under the conditions shown at checkout.
5. Shipping and delivery
Delivery times are estimates unless expressly stated otherwise. We are not responsible for delays caused by carriers, customs procedures or events outside our reasonable control, without prejudice to any mandatory consumer rights under applicable law.
6. Intellectual property
Trademarks, text, images, graphics, video, audio, designs and other Service content belong to ernesto, its licensors or their respective owners and are protected by applicable law. Unless expressly authorised, content may be used only for personal, non-commercial purposes.
7. Optional tools
We may provide access to tools supplied by third parties that we do not control. Use of such tools is at your own risk and is also subject to the provider’s terms. New features and tools introduced as part of the Services will also be subject to these Terms.
8. Third-party links
The Services may contain links to or content from third parties. We do not control those sites and are not responsible for their content, products, practices or services. Review the relevant third-party terms and policies before entering into transactions with them.
9. Relationship with Shopify
The ernesto store uses Shopify as its technology platform. Sales made through the store are directly between the customer and ernesto. Shopify is not the seller of products purchased from ernesto and is not responsible for ernesto’s commercial obligations to customers.
10. Privacy
Personal data processed in connection with the Services is governed by our Privacy Policy. Because the Services use Shopify, certain information may also be processed by Shopify and its providers in accordance with their policies and applicable law.
11. Feedback
If you send us reviews, suggestions, ideas or other submissions, you grant us the right to use them to operate, improve and promote the Services to the extent permitted by law. You confirm that you have the necessary rights to the content you submit and that it does not violate third-party rights or applicable law.
12. Errors, inaccuracies and omissions
Information in the Services may occasionally contain errors or omissions relating, for example, to descriptions, prices, promotions, shipping charges, delivery times or availability. We may correct errors and update information to the extent permitted by law.
13. Prohibited uses
You may use the Services only for lawful purposes. You must not use them to violate laws or third-party rights, distribute harmful or misleading content, transmit malware, unlawfully collect personal data, send spam, bypass security measures or interfere with the operation of the site.

Software, agents or automated services accessing the Services must identify themselves accurately, must not pretend to be human users and must not bypass CAPTCHAs, technical limits or other security measures. We may restrict or block automated access where necessary to protect the Services.
15. Termination
We may suspend or terminate access to the Services where these Terms are breached or where necessary to protect the store, users or third parties. Obligations which by their nature are intended to survive termination will remain in effect.
16. Disclaimer of warranties
To the maximum extent permitted by law, the Services are provided subject to availability. We do not guarantee that the site will always be uninterrupted or error-free. Nothing in these Terms limits warranties or consumer rights that cannot lawfully be excluded.
17. Limitation of liability
To the maximum extent permitted by law, ernesto and its providers are not liable for indirect, consequential or special losses arising from use of the Services. This limitation does not apply where liability cannot legally be excluded or limited.
18. Indemnification
To the extent permitted by law, you are responsible for consequences arising from use of the Services in breach of these Terms, applicable law or third-party rights and will reasonably cooperate in handling related claims.
19. Severability
If any provision of these Terms is held invalid or unenforceable, it will be applied to the fullest extent permitted and the remaining provisions will continue in effect.
20. No waiver; entire agreement
Failure to exercise a right does not constitute a waiver. These Terms, together with the policies referred to and any specific applicable terms, constitute the agreement governing use of the Services.
21. Assignment
You may not assign your rights or obligations under these Terms without our prior consent where such consent is required. ernesto may transfer its rights and obligations in accordance with applicable law.
22. Governing law
These Terms are governed by the law applicable to the registered office of UAB Coop Lithuania, without prejudice to any mandatory consumer protections available in the consumer’s country of residence.
23. Headings
Section headings are included for convenience only and do not affect interpretation of these Terms.
24. Changes to the Terms
The most recent version of the Terms is available on this page. We may update them by publishing a revised version on the site and, where required by law, providing appropriate notice of material changes.
